The fonezone.com.au website ("fonezone.com.au"). is operated by Fone Zone Pty Ltd (“we” or “Fone Zone") ABN 25061796414. Your access to and use of fonezone.com.au and services made available via fonezone.com.au, including the online services such as online ordering, wallpapers, ringtones, games or SMS services or other products provided by funzone.fonezone.com.au or Fun Zone (“Services”) is subject to these terms, the fonezone.com.au Privacy Policy and any other terms contained on this web site ("Terms of Use"), whether or not you become a customer of Fone Zone or fonezone.com.au or Fun Zone. Access to fonezone.com.au and our Services will be via security credentials, which could include a username and password, a digital certificate or other secure technology, (“your details”). fonezone.com.au, its prices, products,services and information provided herein are designed for Australian residents only.
1 What you must do

Fone Zone is entitled to rely on information provided by you or the Company as conclusive evidence of your identity and authority without further investigation. You and your Company (if applicable) are solely responsible for any loss caused by use of information provided by you.
2 What you must not do
2.1 You must not:
(a) use fonezone.com.au or the Services for any activities or post or transmit to or via fonezone.com.au or the Services any information or materials which breach any laws or regulations, infringe a third party's rights, or are contrary to any relevant standards or codes;
(b) use fonezone.com.au or the Services in a way or post to or transmit to or via fonezone.com.au or the Services any material which interferes with other users or defames, harasses, threatens, menaces, offends or restricts any person or which inhibits any other user from using or enjoying fonezone.com.au or the Services;
(c) use fonezone.com.au or the Services to send unsolicited electronic mail messages to anyone;
(d) make any fraudulent or speculative enquiries, bookings, reservations or requests using fonezone.com.au or the Services;
(e) use another's name, username or password without permission;
(f) post, or transmit via fonezone.com.au or the Services, any obscene, indecent, inflammatory or pornographic material or material that could give rise to civil or criminal proceedings;
(g) tamper with, hinder the operation of or make unauthorised modifications to fonezone.com.au or the Services;
(h) knowingly transmit any virus or other disabling feature to fonezone.com.au or the Services; and
(i) attempt any of the above acts or permit another person to do any of the above acts.
3 Third Party Content

3.2 The third party products, services and information are not provided or endorsed by us and your legal relationship is with the third party supplier.
3.3 We have not checked the accuracy or completeness of the information or the suitability or quality of the products and services of the third parties. You should check with the third party supplier whether there are additional charges and terms which may apply.
3.4 We may receive fees and/or commissions from third parties for goods and services of such third parties displayed or made available on fonezone.com.au or the Services or accessible through a hyperlink on fonezone.com.au or the Services. You acknowledge and consent to us receiving the fees.
4 Prices and products and services are subject to change
4.1 All prices displayed and products and services offered to be supplied on fonezone.com.au are subject to change without notice.
5 fonezone.com.au or the Services Messaging Services
5.1 We provide messaging services via fonezone.com.au or the Services (eg Secret SMS). We will endeavour to ensure the continuity of our messaging services.
5.2 We may delete any message sent to you or by you if:
(a) the size of the message (including attachments) exceeds 4MB;
(b) the size of the message (including attachments) when multiplied by the number of recipients of the message exceeds 4MB;
(c) all of your undeleted messages (including attachments) exceed 4MB.
If we delete electronic messages, we are not obliged to notify you or the sender of the message.
5.3 We may delete your electronic address mailbox and reassign your mailbox username to another person if you do not use a messaging service for a period of 100 calendar days.
5.4 You are responsible for all equipment and software used to access the messaging services, and for the consequences of any filtering or other application you choose to apply to the messaging service.
5.5 From time to time, we may need to send you some important messages about the messaging services which are essential or relate to a service.
5.6 Without limiting the grounds on which we may terminate your access to fonezone.com.au or the Services under these Terms of Use, we may terminate your access to a messaging service at any time by giving you 24 hours notice.
6 Security
6.1 For security reasons we may require you to re-authenticate yourself from time to time, for example after a period of inactivity on the connection between your browser and the fonezone.com.au or the Services servers. We are not responsible for any information you may lose if the fonezone.com.au or the Services servers terminate your browser session due to prolonged periods of inactivity between your browser and the fonezone.com.au or the Services servers.
6.2 You must comply with all directions issued by Fone Zone pertaining to use of the Services and access to fonezone.com.au or the Services. You (or your Company) will be responsible for providing the computer, hardware, software and all other equipment necessary to access the Internet and you must not send or disclose your details to any other person or entity or store it in a manner that would reasonably allow another person or entity to obtain access to your details, except as specified in clause 6.3 below. If you choose to use a workplace email address to access the Services, you are responsible for ensuring that such use complies with any rules, policies or protocols which apply to the use of the Internet in your workplace.
6.3 You must not keep your details in any form, whether encoded or unencoded, in a location where it is capable of being copied or used by any person or disclose your Member ID to any other person, other than:
(a) yourself, in the case of a Member who is acting as an individual on behalf of themselves; or
(b) another employee of your Company, in the case of an individual who is acting as an authorised representative of a Company, provided that such other employee agrees to be bound by these Terms of Use, and in all cases, you must keep any computer on which your details are stored physically secure and take all necessary precautions (including, without limitation, when downloading and running third party programs off the Internet) to protect any computer from viruses or programs which might make your details on the computer accessible to third parties.
6.4 You must immediately notify Fone Zone if you become aware:
(a) that your details have been compromised or is known to a third party; or
(b) of any unauthorised use of your details; so we can take steps within Fone Zone's control to deactivate any orders or services requested within a reasonable time of being so notified. Notice provided by you under this clause does not release you from your responsibilities under this agreement.
6.5 Fone Zone does not guarantee:
(a) the security of fonezone.com.au or the Services or any systems (including the Internet and the Customer's hardware and software) used in accessing fonezone.com.au or the Services, or any information passed through such systems; or,
(b) access to fonezone.com.au or the Services or any systems used in accessing Fone Zone will be continuous or virus or error free.
7 Privacy
You acknowledge that under these Terms of Use, Fone Zone may provide personal information about you as part of the Services which is subject to privacy legislation. As a result, you must not disclose or permit the disclosure of your detials to any other person as this may result in your privacy being breached. You further acknowledge that Fone Zone is entitled to assume that all use of your details is by you, unless and until Fone Zone receives notification from you of a compromise of your details and has a reasonable time to deactivate any order or request for services by you, your company or any agent of either entity autorised or otherwise. Fone Zone will comply with its Privacy policy located on fonezone.com.au in dealing with any information associated with your use of the Services. You must not breach or permit a breach of any other person's privacy in using the Services, including without limitation using another person's details.
8 Customer Communications
You acknowledge that where the Services require Fone Zone to contact you, the following will apply :
(a) Fone Zone will address and send electronic messages to you to the electronic address or addresses provided by you; you are solely responsible for ensuring that your contact details for the Services are current (including email, SMS, EMS and MMS addresses), your email and telephone services are operational and that you check your emails, SMS, MMS & EMS regularly;
(b) you must notify Fone Zone of any changes to your Services details using the online contact forms provided by fonezone.com.au and the Services as soon as possible;
(c) if Fone Zone sends an electronic message to your current address as listed in your Services contact details, you are deemed to have received that message and Fone Zone is not obliged to take any further action to confirm that you have received, opened and/or read the message unless you promptly notify Fone Zone and demonstrate that the message was not delivered to your electronic address;
(d) if Fone Zone receives an automated email non-delivery notification indicating you have not received the email that Fone Zone has sent you containing or regarding an order for a Service, Fone Zone will use reasonable endeavours to attempt to contact you using the other contact details that you submitted in your Services contact details, including non-electronic means, but does not guarantee that Fone Zone will be able to contact you. For the avoidance of doubt, Fone Zone will not attempt to contact you via alternate means if Fone Zone receives an automated email non-delivery advice on a bill email notification sent by Fone Zone to you pursuant to section 9 below; and
(e) Fone Zone may contact you via the contact number provided by you if your order is incomplete or needs further explanation.
9 Indemnity
9.1 You indemnify us and our officers, employees, agents and related bodies corporate from and against all actions, claims, suits, demands, damages, liabilities, costs or expenses arising out of or in any way connected to the use of fonezone.com.au or the Services by you or someone using your name and password.
10 Disclaimer and limitation of liability
10.1 To the extent permitted by law, neither we nor any of our officers, employees, agents or related bodies corporate will be liable in any way (including for negligence) for any loss, damage, costs or expenses suffered by you or claims made against you through the use of fonezone.com.au or the Services, any failure to provide fonezone.com.au or the Services, including a messaging service, or in connection with any products, services or information supplied, offered to be supplied or advertised via fonezone.com.au or the Services.
10.2 To the extent permitted by law, all warranties, conditions and representations about fonezone.com.au or the Services, the availability of fonezone.com.au or the Services for access and use, the products and services advertised, offered to be supplied or supplied via fonezone.com.au or the Services and the information provided on fonezone.com.au or the Services are excluded. If a term is implied by law into these Terms of Use and the law prohibits provisions in a contract excluding or modifying liability under that term, then it will be included in these Terms of Use. However, our liability for breach of such term will be limited, at our option, to one or more of the following (a) in relation to goods: (i) the replacement of the goods or the supply of equivalent goods; (ii) the repair of such goods; (iii) the payment of the cost of replacing the goods or acquiring equivalent goods; or (iv) payment of the cost of having the goods repaired; (b) in relation to services: (i) the supply of the services again; (ii) the payment of the cost of having the services supplied again.
10.3 You acknowledge that you have not relied on any representation made by Fone Zone which has not been stated expressly in these Terms of Use. Fone Zone may change these Terms of Use and any other information relating to the Services, including prices, at any time and your subsequent use of your Member ID will be governed by the varied Terms of Use. Without limiting Fone Zone's ability to give notice by any other means, the Customer will be deemed to have:
a. received adequate notice of such changes where Fone Zone places a notice on the Fone Zone Online Services website setting out such changes; and
b. agreed to such changes the next time they use their Member ID after publication of the relevant notice on the Fone Zone Online Services website.
11 Use of your information and material
11.1 When you send us any feedback, suggestions, ideas or other materials in relation to or via fonezone.com.au or the Services, you agree that we can use, reproduce, publish, modify, adapt and transmit them to others free of charge and without restriction, subject to our obligations in our Privacy Statement.
12 Goods and Services Tax
12.1 If GST is imposed on any supply made by us through fonezone.com.au or the Services, you must pay to us, in addition to any consideration payable or to be provided by you for this supply, an additional amount for the supply calculated by multiplying the prevailing GST rate by the consideration for the relevant supply payable or to be provided (without any deduction or set off) by you under any other clause in these Terms of Use. Any amount payable by you is payable on demand by us, whether such demand is made by an invoice or otherwise.
13 Changes
13.1 We may vary any of these Terms of Use at any time and any other information relating to the Services, at any time and your subsequent use of the Member ID will be governed by the varied Terms of Use.
Without limiting Fone Zone's ability to give notice by any other means, you will be deemed to have:
a. received adequate notice of such changes where Fone Zone places a notice on fonezone.com.au web site advising that these Terms of Use have been changed; and
b. accepted the changes to these Terms of Use and agreed to be bound by the revised Terms of Use if you continue to use fonezone.com.au and/or to access the Services after the date that notification of changes on the fonezone.com.au web site is posted.
14 Termination
14.1 If, in Fone Zone's reasonable opinion, you breach any of these Terms of Use, we may suspend, terminate or limit your access to fonezone.com.au or the Services and terminate the Terms of Use effective immediately. We reserve the right to cancel your order or request for service at any time without notice and/or to discontinue one or more of the Services at any time for any reason. Any withdrawal by Fone Zone of the Services will not affect the validity or operation of any contract governing the supply of goods and/or services acquired by means of the Services.
15. General Matters
15.1 This agreement is governed by the law in force in the State of Queensland, Australia, and the parties irrevocably submit to the non-exclusive jurisdiction of the courts of Queensland, Australia and courts of appeal from them for determining any dispute concerning this agreement.
15.2 If any of these Terms of Use are invalid or unenforceable, it will be struck out and the remaining terms will remain in force.
15.3 If we do not act in relation to a breach by you of these Terms of Use, this does not waive our right to act with respect to subsequent or similar breaches.
15.4 You may not assign or transfer your rights or benefits under these Terms of Use to any other person or entity without the prior written consent of Fone Zone.
16. Conditions of sale
16.1 If you are dissatisfied with your handset purchase you may seek an exchange by returning the goods at your own expense in their complete, original packaging. All goods returned must be undamaged, free of scratches or other signs of wear and tear. Goods not returned within 10 days of receipt in their complete original packaging will remain your property and no exchange will be issued. You will need to pay for your monthly spend and usage charges.
16.2 If you have requested a Telstra service and your service is cancelled, you do not pay your bill or you reduce your monthly spend within the contract period you may be charged a fee. This fee will equal your remaining repayments. If you do not pay your bill Telstra may suspend or disconnect any or all of the services on your bill.
16.3 If your phone stops working during the contract period at any time, you will still need to make your repayments. If your phone requires service and you wish to access a loan phone a charge will apply for the loan phone if you have not taken up our Entire Service Package.
16.4 The information provided by you in the application process may be used by Fone Zone, Telstra, credit checking agencies or other entities to confirm and disclose your intention to take up this service. Fone Zone may use this information to contact you about your service, your handset or other issues related to the continued servicability of your phone and service.
16.5 Where you may have selected a single billing option and you do not pay all or part of your bill Telstra may discontinue any or all of the services on your bill.
